2. Check your forum
“Workman” under the ID Act? Labour Commissioner. Managerial role? Civil suit or summary suit. PF/gratuity? Their own authorities — EPFO grievance (EPFiGMS) and the Controlling Authority under the Gratuity Act.
3. File with the Labour Commissioner
A simple application; conciliation is free and surprisingly effective — many employers pay at the first notice.
4. Gratuity has a deadline
Apply in Form I within 30 days of it falling due; the employer must pay within 30 days or owes interest.
5. Keep the relieving-letter issue separate
Don’t trade documents for dues — claim both. Withholding relieving letters to force “settlements” is challengeable.
Good to know: Limitation for money claims is generally 3 years — but memories and witnesses fade much faster. Move within weeks, not years.
